Bidding

  1. Create Your Account

In order to bid in an online auction, you will first need to set up an account.

We host our online auctions with LiveAuctioneers and Invaluable.

  1. Register For Auction

In Person

You may register for a paddle at our registration desks either, the day of the auction or, during preview.

If you pre-register during preview, on the day of the auction you may pick up your paddle at our registration desk.

We are located at 5200 South Dixie Hwy West Palm Beach, FL 33405.

Phone Bids

You may register by filling out the telephone/absentee bid form up to 48 hours in advance of an auction.


Please note that you must receive confirmation from us that your telephone bid form has been received and processed.

If you do not receive confirmation your form may not have been received.

LiveAuctioneers:

To actively bid in an auction on LiveAuctioneers, you must register first by clicking ‘Register for Auction’ on catalog and item pages.

You may also place absentee bids in advance of the auction time, which doubles as registration requests if you’re not already approved.

Most auction houses approve registrations within 24 hours. Every auction house has different criteria for approval, so it’s best to register early in case they require additional information from you. Once approved, any absentee bids you may have placed will be active.

Invaluable:

See something that catches your eye? Click ‘Register to bid’ on the lot page, which sends a request directly to the auction house.

You’ll be asked to provide a bit more information about yourself.

  1. Place Your Bids

In Person

Once the auction begins, the auctioneer will clearly announce the lot number and starting bid price.

To place a bid, raise your paddle so that the Auctioneer sees you and acknowledges your bid.

The auctioneer will accept increasing bids on the Lot until one final bidder remains, at which time the auctioneer will give 'Fair Warning' that the bidding is about to close.

Finally the Auctioneer will sell the item for the last amount bid. This amount is known as the 'hammer price'.

The Auctioneer will announce the hammer price and the winning bidder's paddle number.

Phone Bids

You will be assigned a staff member who will call you the day of the auction when your lot is coming up. They will let you know what bid the auctioneer is asking for and execute bids at your discretion. If you are successful, an invoice will be sent to you the next day.

LiveAuctioneers:

Each auction house handles shipping and payment differently, so before you bid, be sure to review shipping and payment policies to avoid any surprises. Also be sure to take note of the auction’s live bidding start time. This is when live bidding begins, starting with the first lot in the auction.

There are two ways to bid:

Absentee bidding

You can place absentee bids in advance of the live auction. Our hassle-free absentee bidding system ensures you get the best prices.

Be sure to submit your maximum bid amount before the live auction begins. Your bid stays at the lowest minimum amount required to keep you in the lead, and increases (up to your max amount) only if another bidder places a competing bid.

Live bidding

Your chances of winning are three times greater when you bid during the live auction.

Live auctions begin at the time indicated on catalog and item pages. To bid live, simply visit the catalog or item at the indicated auction time, and click ‘Enter Live Auction’. You will be taken to the bidding console where the live auction is taking place.

Invaluable:

Once a live auction begins, Invaluable bidders gain access to an online bidding console that simulates all of the aspects of being at the auction house in person.

If you have registered and been approved to bid by the auction house, you can place live bids by following the steps below:

Sign into your Invaluable account using your email address and password.

Click Auctions > Upcoming Auctions.

Locate the auction you would like to bid in, and click the Happening Now button to open the bidder console.

When the teal Bid Now button displays the price you would like to bid, just click the button to place your bid.

  1. Payment

Payment is due immediately after the sale concludes. All sales are final. All lots are sold 'as is'. The buyer's premium is 20% and is charged on each lot sold. It is calculated on the final hammer price. In addition there is a Florida sales tax of 7%.

LiveAuctioneers:


If an auction house accepts online payments via LiveAuctioneers, invoices will contain a blue ‘Pay Now’ button where you can check out via credit card. Otherwise, you will need to either follow invoice instructions or contact the us for payment processing.

Invaluable:

We are pleased to introduce the ability for buyers to submit payment via credit or debit card directly through Invaluable for items won.

You can also check the “Payment” tab on lot details page or look in the terms and conditions section to find the specific methods accepted.

  1. Shipping

Congratulations, you won!

After you win and pay for your item, we will help you navigate the shipping process.

The simplest method is to receive your shipment directly or, if you are local, to arrange an in-person pick-up.

However, these options are not always possible, so be sure to make an informed bid. Review the terms and conditions for the sale and contact us directly if you have any questions about shipping before placing your bid.


We can provide you with an estimate for packaging/shipping in house or provide a list of shippers who offer a wide array of packing and shipping options. For further information email us at [email protected].

All property sold should be picked up from our premises or shipped within five (5) business days following the auction. After that time property not removed will be subject to a handling charge and storage as outlined in our Terms and Conditions.

Our specialists will review your submission at no cost and provide preliminary estimates for items that can be included in one of our sales channels in 15 to 20 days.

  1. Estimates and Appraisals

We offer free estimates and appraisals to all of our clientele.

Our specialists evaluate property based on its characteristics such as the artist or maker, country of origin, provenance, date of execution, materials, dimensions, rarity, subject matter or type, and condition.

We also consider comparable sales and past performance of works by the same and similar artists.

  1. Pricing and Payment

The seller’s contract sets the reserve price and the seller’s commission.

For sold lots, A.B. Levy's will send payment within 45 days from the sale date, provided we are in receipt of the buyer’s payment.

Your payment will be based on the hammer price less a commission and any agreed-upon expenses.

If bidding on your item fails to reach the reserve price, we will not sell the piece at auction.

Together, we will determine the best course of action, whether this is taking back your work, offering it in a later auction or through our private sales department.

  1. Shipping and Insurance

Our staff can help arrange to have your property delivered to the A.B. Levy's location where it will be offered at auction.

As the consignor, you are responsible for packing, shipping and insurance charges.

Conditions of Business for Buyers

These Conditions of Sale constitute A.B. Levy’s (herein referred to as "A.B.L.'s") and the Consignor’s entire agreement with the purchaser relative to the property offered for sale by A.B.L.'s in its catalogues.


These Conditions of Sale are the complete and only terms and conditions on which all property is offered for sale.

  1. Property Offered for Sale

All property is sold “AS IS.” Neither A.B.L.'s nor the Consignor makes any guarantees, warranties, or representations, express or implied, with respect to the description, provenance, authenticity, quality, merchantability, fitness, value, physical condition, the historical importance, provenance, exhibitions, literature or historical relevance of any property offered for sale or the correctness or accuracy of any catalog description provided by A.B.L.'s.

No statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty, or representation. Prospective bidders should inspect the property before bidding to determine anything that may be of significance to them including, without limitation, the property’s condition, size, authenticity, value and whether or not it has been repaired or restored.

A.B.L.'s and the Consignor make no representation or warranties as to whether the purchaser acquires any reproduction rights with any property.

  1. Refund for Counterfeit Items

However, if within 30 calendar days after the sale of any lot the purchaser gives notice in writing to A.B.L.'s that the lot is counterfeit and within 14 calendar days after such notice the purchaser returns the lot to A.B.L.'s in the same condition as when sold, and the purchaser also within 14 calendar days after such notice demonstrates to A.B.L.'s satisfaction, by providing properly executed and notarized affidavits by two (2) recognized experts in that particular field in which the lot is categorized, that it is counterfeit, A.B.L.'s will refund the full purchase price.

  1. Buyer’s Premium

A buyer’s premium will be added to the successful bid price of each lot and is payable by the purchaser as part of the total purchase price.

The buyer’s premium for lots is 20% of the successful bid price up to and including $100,000.

  1. Right to Withdraw Property

A.B.L.'s reserves the right to withdraw any property prior to the commencement of the auction, without any notice or explanation, unless otherwise announced by the auctioneer. All bids are by lot as numbered and described in auction catalogues. Although in A.B.L.'s discretion we do accept or authorize telephone bids as a convenience to buyers, who are not able to attend the auction, A.B.L.'s is not required to do so and is not responsible for any errors or omissions in connection therewith.

  1. Auctioneer’s Discretion

The auctioneer has the right at his absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he may decide, to withdraw or divide any lot, to combine any two or more lots and, in the case of error or dispute, and whether during or after the sale, determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute.

If any dispute arises after the sale, our record is conclusive.

  1. Risk and Removal of Property

On the fall of the auctioneer’s hammer, title to the offered lot will pass to the highest bidder acknowledged by the auctioneer, subject to fulfillment by such bidder of all the conditions set forth herein and such bidder thereof (a) assumes full risk and responsibility thereof, (b) will pay the full purchase price of the auction, or such part as the A.B.L.'s may accept, and (c) will remove the property from A.B.L.'s premises at its own expense not later than 5 business days following the sale. If any portion of the purchase price is not paid when due, it shall bear interest at the rate of 1.2% per month.

  1. Failure to Comply with Conditions

If any applicable conditions contained here are not complied with by the purchaser, A.B.L.'s may, in addition to and without limitation:

(a) hold the purchaser liable for the total purchase price,

(b) retain any payment made by the purchaser, and

(c) resell the property at public auction without reserve or privately with the purchaser liable for any deficiency, plus all costs of sale, expenses of both sales, attorney’s fees, commissions, incidental and consequential damages and all other charges due hereunder.

In addition, a detailing purchaser hereby grants to the A.B.L.'s a security interest in the property and any proceeds therefrom to secure the purchaser’s obligations to any property in the A.B.L.'s possession owned by such purchaser.

  1. Reserve Prices

Unless otherwise indicated, all property offered is subject to a reserve, which is the confidential minimum price below which the lot will not be sold. The reserve will not exceed the estimated price in the catalogue. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the Seller. The auctioneer may continue to bid on behalf of the Seller up to the amount of the reserve either by placing consecutive bids or by placing bids in response to other bidders to protect the seller’s reserve.

  1. Taxes

Unless exempt by law, the purchaser shall pay any state and local sales or use tax at the time of the payment as part of the total purchase price or any part thereof. Buyers who intend to export their purchases shall present a signed and stamped export declaration form to A.B.L.'s prior to or at the time of payment.

  1. Jurisdiction

These Conditions of Sale as well as the purchaser’s and A.B.L.'s respective rights and obligations hereunder shall be governed by and construed and enforced in accordance with the laws of the State of Florida, binding upon them, whether present in the State of Florida or not.

By bidding at the auction or otherwise, the purchaser shall be deemed to have consented to the jurisdiction of the state courts and of the federal courts sitting in the State of Florida.

  1. Packing and Shipping

A.B.L.'s may arrange delivery of purchased lots, within or outside the State of Florida, produce reasonable written storage or agree given by the purchaser, and full payment is made for and packing, shipping and insurance charges.

A.B.L.'s is not responsible for the acts or omissions of carriers or packers or their agents or employees. If purchased lots, whether or not recommended by A.B.L.'s, the packing and handling of purchased lots by A.B.L.'s is at the entire risk of the purchaser.

In no event will A.B.L.'s be liable for damage to glass, frames, regardless of the cause.

  1. Payment Terms

Terms of payment: cash (may not exceed $10,000), personal check with valid identification, money order, cashier’s check, or wire transfer.

Unless prior to purchase, prior to being released or shipped, if you wish to pay with American Express, MasterCard or Visa, you must present the card in person to A.B.L.'s. All charges made using the credit card are on approval by the card Issuer.

Credit card purchases may not exceed $10,000. Under no circumstances, will A.B.L.'s liability to a purchaser exceed the final purchase price actually paid.

How Do I Pre-Auction?

A.B. Levy Auctions are governed by our Conditions of Sale. Please review and understand these terms before bidding. We offer a printed auction catalog approximately one week ahead of each auction, when available. Clients may also view our catalog online at our website when available. Both the printed catalog and our online catalog contain photographs, descriptions and estimates for each lot. A.B. Levy strongly encourages clients to inspect all lots of interest, in person. Can I Preview An Auction?

Our auction showroom is open to the public five days prior to the auction for preview. At this time, all lots may be examined and our staff will be available to answer questions.

What's Your Bidding Process?
